These Terms of Use govern your access to and use of jayleemcgary.com (the "Site"). By visiting or using the Site, you agree to these terms. If you don't agree, please don't use the Site.
These terms cover the website only. Any consulting, speaking, advisory, training, or other professional services I provide are governed by a separate written agreement between you (or your organization) and me — not by these terms.
1. Informational use only
The content on this Site — articles, journal entries, resource pages, and downloadable materials — is provided for general informational and educational purposes. Nothing on this Site is medical, legal, financial, regulatory, or clinical advice, and reading it does not create a nurse–patient, consultant–client, or professional relationship of any kind.
For decisions about your health, a loved one's care, or your facility's operations, please work with your own qualified professionals.
2. Intellectual property
All content on the Site — including writing, images, photography, graphics, logos, brand marks, and the overall look and feel — is owned by me or licensed to me and is protected by copyright and other intellectual property laws.
You may view, share links to, and quote short excerpts of Site content with clear attribution and a link back. You may not republish full articles, reproduce the Site's design, scrape content for AI training, or use any content for commercial purposes without my prior written permission.
3. Acceptable use
You agree not to:
- Attempt to disrupt, overload, or breach the Site or its underlying infrastructure.
- Use bots, scrapers, or automated tools to harvest content or personal information.
- Impersonate me or misrepresent your affiliation with me or my work.
- Submit unlawful, defamatory, harassing, or infringing content through any form or comment field.
- Use the Site or its content in any way that violates applicable law.
4. Forms, comments, and submissions
When you use a contact form, comment field, subscribe form, or other input on the Site, you are responsible for what you submit. Don't include protected health information, sensitive personal data, or information you don't have the right to share. By submitting content, you grant me a non-exclusive right to read, store, and respond to it as needed to operate the Site and reply to you.
5. Third-party links
The Site may link to third-party websites, products, or services. Those links are provided as a convenience. I don't control and am not responsible for the content, policies, or practices of any third-party site.
6. No warranties
The Site is provided "as is" and "as available," without warranties of any kind, express or implied. I don't warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components, or that its content is complete, current, or accurate at any given moment.
7. Limitation of liability
To the maximum extent permitted by law, I will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, including any reliance on Site content. My total liability arising from your use of the Site will not exceed one hundred U.S. dollars (US $100).
8. Services are separate
Consulting engagements, training, speaking, retainers, and any other paid services are governed by a separate signed agreement that defines scope, fees, deliverables, confidentiality, and liability for that work. Nothing on this Site — including service descriptions, sample materials, or pricing references — constitutes an offer to contract or modifies any signed services agreement.
9. Changes to these terms
I may update these Terms of Use from time to time. When I do, I'll change the "Last updated" date at the top of this page. Continued use of the Site after an update means you accept the revised terms.
10. Governing law
These terms are governed by the laws of the State of South Dakota, United States, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be brought in the state or federal courts located in South Dakota.
